You will also understand the procedure of a commercial transaction and acquire a basic knowledge of the relevant statutory provisions. We will also consider the different needs and expectations of the commercial client.

- The Standard Commercial Property Conditions
- VAT on property transactions - including the latest requirements on a TOGC
- Transfer of business tenancies
- TUPE on the sale of a going concern
- Enquiries, searches and planning considerations
- The basic definitions under the Landlord and Tenant Act 1954 Part II as amended by the new Regulatory Reform (Business Tenancies) (England and Wales) Order 2003 which took effect on the 1st June 2004
- Contracting out and the new replacement procedure
- ‘Competent landlords’ and arguments on renewal – the ‘O’May principles’
- S40 Notices; S25 Notices and S26 Notices, counter-notices and the new procedures
- The Landlord and Tenant (Covenants) Act 1995
- VAT and SDLT; break options and ‘notices’ generally
Under the SRA’s new approach to continuing competence, solicitors are expected to use the Statement of Solicitor Competence to identify and address their learning and development needs. The competence statement requires the following competencies:
- A - Ethics, professionalism and judgement
- B - Technical legal practice
- C - Working with other people
- D - Managing themselves and their own work
Who is this course for?
This course will be of benefit to trainees and domestic conveyancers who are from time to time called upon to deal with commercial property matters. It is also ideal for those moving from the residential conveyancing department to the commercial property department.
