  • Have consider when damages can be awarded and the funding options available including legal aid, CFA and privately paying clients and will
  • Know what questions to ask in request of assault/battery claims
  • Have considered the remedies available from the court and via out of court settlement.
  • Be aware of the time limits involved in respect of judicial review, racial discrimination, breach of Hunan Rights Act etc
  • Be familiar with the legislation which governs the complaints procedure, namely Police Reform Act (2002) and Police Reform and Social Responsibility Act (2011)
  • Be familiar with the types of complaints which can be made inc. local resolution, local investigation and direct referral to IPCC
  • Have considered the legal justification for trespass and how this over-laps with Article 8 Human Rights Act 1998
  • Be aware of what the claimant must prove in order to pursue a negligence claim

This course will provide viewers with an introduction to civil actions against the police and will offer practical advice on how to handle such cases.

This course, delivered by Kevin Donoghue of Donoghue Solicitors which specialise in civil actions against the police, will be of particular interest to PI and civil practitioners who are new to this area of practice or those who would like to expand their knowledge in this area of law.

This course will consider what civil actions against the police are and will discuss the following heads of claims in turn and will offer examples of circumstances in which each claim will apply:

  • Malicious Prosecution
  • Misfeasance in Public Office
