Description

What is the Mental Capacity Act?

The Mental Capacity Act 2005 was designed to protect the rights of potentially

vulnerable adults who might otherwise be prevented from making their own choices

and decisions. By the end of this manual you should understand how the Act will

affect your working practices, how by complying with it you are protecting the best

interests of your clients and what you will need to do to demonstrate your

compliance to the Care Quality Commission.

It is now law that ALL adults must be assumed to have the capacity to make

decisions and take actions for themselves unless after being provided with

appropriate support and information it can be shown that they do not.

If it is decided that a person lacks capacity then decisions must be taken in their best

interests and they must be involved in the process as far as possible.

The framework also helps students to understand what qualifications they need to progress towards a higher learning goal, such as a university degree or equivalent higher education award.

An endorsed course is a skills based course which has been checked over and approved by an independent awarding body. Endorsed courses are not regulated so do not result in a qualification - however, the student can usually purchase a certificate showing the awarding body's logo if they wish. Certain awarding bodies - such as Quality Licence Scheme and TQUK - have developed endorsement schemes as a way to help students select the best skills based courses for them.
