Deportation is an important but controversial area of Immigration law with draconian consequences if not properly challenged. As an advisor in this field you are under a duty to ensure you understand the issues the Tribunal will require you to address in a deportation appeal.

This course is an essential and comprehensive review and update of the key issues in deportation. It will provide you with a wealth of information from immigration case law, border agency guidance and policy to the impact of criminal sentencing and human rights. The course will include a workshop in the afternoon where you will get the opportunity to work on case studies and draft skeleton arguments.

Description

By the end of this course you will be able to:

  • Anticipate and understand how deportation will apply in criminal cases.
  • Identify the evidence necessary to oppose deportation
  • Implement practice and procedure
  • Assess and respond to a Notice of intention to deport
  • Draft grounds and skeleton arguments to the Tribunal
  • Employ Article 8 case law in deportation


Under the SRA’s new approach to continuing competence, solicitors are expected to use the Statement of Solicitor Competence to identify and address their learning and development needs. The competence statement requires the following competencies:

  • A - Ethics, professionalism and judgement
  • B - Technical legal practice
  • C - Working with other people
  • D - Managing themselves and their own work

Trainee solicitors, lawyers and those considering immigration accreditation. This may also be of interest to criminal practitioners dealing with foreign nationals.

Requirements

There is no required pre-course preparation however we would advise you to familiarise yourself within the UK Border Act 2007 on deportation.

Study method describes the format in which the course will be delivered.
