About the role
Capita recently entered into a managed services contract with a large organisation operating in the transport sector covering Local Area Network and Wide Area Network services. A Contract Manager is now required to support the account. The Contract Manager will report to the Commercial Director appointed to the contract and will be a key advisor on contractual matters and related commercial risks. They will provide advice and support to the team on the contractual and commercial matters arising in the day to day operation of the contract. The role will involve post contract management, but will also support the sales / pre-sales functions in relation to new business and work with the Group procurement team in relation to supplier matters.

What you will do:
Providing post contract management support, which shall include without limitation:
Ensuring the team are aware of and comply with their contractual obligations and monitoring Capita's compliance against the contract
Advising the team on matters of contractual interpretation
Identifying, managing and reporting on key commercial risks and issues
Managing contractual disputes and claims (for example service credit disputes, allegations of breach, relief claims etc)
Drafting and negotiating variations to and change controls under the contract and liaising with the team regarding the same
Assisting the team with the development and implementation of the processes required to support the contract (for example regarding service acceptance and contract changes, approval of new opportunities etc)
Providing commercial input to the required processes (for example regarding contract changes, approval of new opportunities etc)
Liaising with the customer on contractual matters (for example, attending governance reviews, negotiating change controls etc)
Supporting the business in relation to any TUPE transfers
Assisting the team with sales opportunities including preparation of the required proposals and drafting variations to the contract to affect the same
Working with the Group procurement team in relation to supplier matters, which may involve drafting and negotiating sub-contracts and managing suppliers
Ensuring that Capita internal governance is complied with (for example relevant approvals are obtained, commercial criteria are met, registers are updated etc)
Your experience and skills will include:
You will be degree qualified, preferably from a legal or business discipline
Previous commercial contracts experience, ideally in relation to managed services / outsourcing contracts - experience within the IT or Telecoms industry would be an advantage
Excellent drafting and negotiating skills (terms and conditions and contract schedules), with the ability to work without separate legal support
An excellent understanding of contract law and its application (in the context of commercial contracts)
The ability to manage, interpret and advise on complex contracts
The ability to manage and resolve contract disputes
The ability to provide commercial / legal advice at all stages of the contract process
Experience of developing business processes
Risk management skills
Excellent communication skills, both verbal and written
Confidence, with the ability to lead and influence and develop strong relationships
