This course will give you an essential grounding in both the substantive law and practical aspects of property transactions. You will accumulate an in-depth knowledge of both freehold and leasehold conveyancing in both residential and commercial transactions.

Description

Day 1

By the end of this day you will :

  • Understand the land law which underpins the conveyancing transaction including estates in land, third party rights and equitable interests.
  • Appreciate the differences between registered and unregistered conveyancing.
  • Be familiar with the process of a residential free sale from offer to completion.

Day 2

By the end of this day you will :

  • Understand the nature of leases and be able to distinguish them from other forms of estates in land.
  • Know how a residential lease transaction differs from freehold purchase.
  • Be aware of the assured shorthold regime and how it impacts on transactions
  • Know the usual and CML requirements for residential leases.

Day 3

By the end of this day you will :

  • Understand how commercial conveyancing differs from residential.
  • Know the main provisions of a commercial lease
  • Be familiar with the requirements of the 1954 Landlord & Tenants Act as they apply to business leases.
  • Know all the main additional issues to be aware of when acting for a client in a commercial transaction including VAT, planning, TUPE and contract conditions both standard and special.
